1. Acceptance of Terms

Welcome to KIANO.LLC ("Company," "we," "us," or "our"). By accessing or using our website at it14.org and any related services, including but not limited to our cloud platform, email hosting, database management, and administration console (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and KIANO.LLC.

3. Description of Services

KIANO.LLC operates the IT14.org cloud platform, which provides the following services:

• Professional Email Hosting: Multi-domain email service with webmail interface, IMAP/SMTP access, anti-spam filtering, DKIM, and DMARC configuration.
• Managed Databases: Fully managed PostgreSQL, MySQL, and Redis database instances with one-click deployment, automatic backups, and secure access.
• Administration Console: Centralized dashboard for managing all services, including monitoring, logs, and configuration tools.

All services are delivered electronically via our cloud infrastructure and are accessible through your web browser.

4. Account Registration and Security

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password and login credentials secure and confidential.
• Immediately notify us of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or no longer current.

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable local, state, national, or international law or regulation.
• Send spam, phishing emails, or other unsolicited communications.
• Distribute malware, viruses, or other harmful software.
• Infringe upon the intellectual property rights of others.
• Store, transmit, or distribute illegal content.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the Services for cryptocurrency mining without authorization.
• Engage in any activity that disrupts or interferes with the Services.

Violation of this acceptable use policy may result in immediate suspension or termination of your account without notice.

6. Payment Terms

Certain Services require payment of fees. By subscribing to a paid Service, you agree to:

• Pay all fees in United States Dollars (USD) as indicated at the time of purchase.
• Provide valid and current payment information.
• Authorize us to charge your payment method for recurring subscriptions.

All payments are processed securely through Stripe, Inc., our third-party payment processor. By making a payment, you also agree to Stripe's Services Agreement and Privacy Policy.

Prices are exclusive of applicable taxes, which will be added where required by law. We reserve the right to change pricing with 30 days' advance notice.

7. Subscription and Auto-Renewal

Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current rate at each renewal. You may cancel your subscription at any time through your account dashboard or by contacting support@it14.org.

8. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, software, and code — are the exclusive property of KIANO.LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

You retain ownership of all data and content you upload or store through our Services. By using our Services, you grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Services to you.

9. Service Availability and Uptime

We strive to maintain high availability for all Services. However, we do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make commercially reasonable efforts to provide advance notice of planned maintenance windows.

10. Data Backup and Responsibility

While we perform regular automated backups of managed databases, you are responsible for maintaining your own backup copies of critical data. KIANO.LLC shall not be liable for any data loss resulting from hardware failures, software errors, or user actions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIANO.LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Indemnification

You agree to indemnify, defend, and hold harmless KIANO.LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the Services or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Services will immediately cease.
• You remain liable for any outstanding fees.
• We may delete your data after a 30-day grace period following account termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Terms of Sale, and Refund Policy, constitute the entire agreement between you and KIANO.LLC regarding your use of the Services.
